 How to Obtain Marriage License

DeKalb County

Location:
DeKalb County Courthouse, Judicial Tower, Room B190 (basement floor) 
Hours of Operation (excluding holidays):  Monday-Friday, 8:00 AM-5:00 PM Note:  Applications for marriage licenses are accepted until 4:30 PM.  

General Information:
Georgia residents may apply for a marriage license in any county in Georgia. If neither applicant is a resident of Georgia, the marriage license must be obtained in the county where the ceremony is going to be performed.  The marriage license is valid only for ceremonies performed in Georgia.  Premarital blood tests are no longer required in Georgia.   

Requirements for Marriage License:
Both applicants must be present in order to obtain a marriage license.  You must provide proof of age.  Documents that are accepted include, but are not limited to, a valid driver’s license, original or certified copy of birth certificate, valid passport, or valid armed forces identification card.  See O.C.G.A. § 19-3-36 for more information.  You must be at least 16 years of age to obtain a marriage license.  If you are 16 or 17 years of age, parental consent is required.  See O.C.G.A. § 19-3-37 for more information.  If either applicant has been divorced, you must present a copy of the final divorce decree(s).  If either applicant presents a legal document in a language other than English, the applicant must attach a translation of the document by a certified translator.
    
Fees for Marriage License:
Without Certificate of Premarital Education o The fee is $56.00. With Certificate of Premarital Education, the fee is $16.00.   A signed and dated certificate of completion from a qualifying premarital education program with at least six hours of instruction must be provided.  Certificate of Completion of Qualifying Premarital Education form is available on the DeKalb County Probate Court website.   See O.C.G.A. § 19-3-30.1 for more information about premarital education.  

Forms of Payment:
Cash, certified check, or money order is required.   Certified checks and money orders should be made payable to DeKalb County Probate Court.The court does not accept personal checks, credit cards, or debit cards.   All fees are nonrefundable. 
  
Certified Copies:
The fee for a certified copy of a marriage certificate is $10.00.    The fee for a certified copy of a marriage license application is $10.00.   You can request certified copies either in person or by mail to the following address:  Probate Court of DeKalb County 556 North McDonough Street B190 Judicial Tower Decatur, Georgia  30030.   When requesting by mail, send the following: o Completed Request for Certified Marriage Documents form;  Form is available on the DeKalb County Probate Court website. o Certified check or money order made payable to DeKalb County Probate Court; Self-addressed stamped envelope.

​Fulton County

Must be at least 18 years of age.

Both applicants must appear in person.

(a) If one or both persons to be married are residents of Georgia you may apply for a marriage license in any county in Georgia.
(b) If neither applicant  are residents of Georgia you must then apply for the marriage license in the county where the ceremony is to be held.  

When:
Monday - Friday 8:30 a.m. - 4:00 p.m.

Proof of age:
Including but not limited to a Driver's License, Passport or Birth Certificate. (Documents not in English must be accompanied by certified English translation).   See OCGA §19-3-36.

General Information
If applicable, customers need to know their date of divorce and/or date of death of previous spouse.
If a divorce was granted, for either party,  within  30 days of applying for a marriage license, then the party must  provide a copy of the divorce decree.

Cost:
There are two sets of fees for marriage license applications.The fee is either $56.00 (without certificate*) or $16.00 (with certificate*). The application fee is waived when the couple seeking the license has completed a qualifying premarital education program. A certificate of completion of a qualifying premarital education program in accordance with Code Section 19-3-30.1 must be presented for the $40.00 application fee to be waived. Other fees and costs still apply. See below.

Certified Copies
Certified Copies of the Marriage Certificate and Application are $10.00 each in  addition to the above fees.   If you would like the copies to be mailed to you, you must provide a self-addressed, stamped envelope.
